1. Program Participation Agreement

Program Details:
Details regarding all program or retreat experiences, such as Kinsmen, including destination, accommodations, dates, meals, transportation, and payment information, can be accessed on our website. It is imperative to thoroughly review and understand these details and policies before proceeding with registration.

2. Registration

To secure your spot for the program or retreat experience, you must add the corresponding product to your cart and complete the checkout process, including the submission of necessary information and a non-refundable deposit specified on the website. Failure to provide complete registration materials may result in the forfeiture of your reservation.

3. Confirmation and Itinerary

Upon receipt of your registration materials, you will receive a confirmation email. Any subsequent correspondence regarding the program or retreat experience, including itinerary details, is subject to modification by us due to factors such as vendor availability, weather conditions, or other unforeseen circumstances.

4. Accommodation and Meals

While we carefully select accommodations, we are not liable for any issues or modifications to them during the program. Participants consume food provided by us or the accommodation provider at their own risk, and we are not responsible for losses incurred due to allergies or dietary requirements.

5. Payment Terms
 
  • Total Payment: Due in full no later than twenty-one days before the program date. Failure to submit payment by the due date may result in cancellation without notice.
  • Deposit: Non-refundable under all circumstances from time of booking, equating to 30% of the total program fee.
  • Early-bird Pricing: Available if full payment is received by the specified deadline.
  • Currency and Payment Methods: All pricing is in Australian Dollars, and any currency conversion charges are the participant's responsibility. Credit card payments may incur a surcharge.

6. Travel Arrangements

Participants are responsible for booking and confirming their travel arrangements to and from the program or retreat location. We are not liable for any issues or losses resulting from flight cancellations or delays, and participants must ensure timely arrival at the destination.

7. Travel Insurance

We strongly recommend purchasing travel insurance to cover potential losses or expenses during the program or retreat. Participants are solely responsible for arranging adequate insurance coverage.

8. Weather

We are not liable for losses resulting from inclement weather or other natural phenomena that may affect the program or travel arrangements. No refunds or credits will be provided for disruptions caused by weather conditions.

9. Changes or Cancellations

Changes: We reserve the right to modify aspects of the program or retreat if necessary, with no eligibility for refunds.
Cancellations: We may cancel reservations for non-payment or unforeseen circumstances. In such cases, participants may transfer their payment to another program within 18 months.

10. Media Release

Participants grant us the right to use their image, likeness, and voice for marketing purposes without compensation, acknowledging the use of such media in various formats.

11. Voluntary Participation in Physical Activities

Participants acknowledge and voluntarily assume the risks associated with physical activities involved in the program or retreat, including but not limited to walking, running, hiking, swimming, and other outdoor activities inherent to nature-based programs. They also acknowledge that some challenges may include nighttime activities, which may be surprising but are designed for their benefit and personal development.

12. Health and Fitness Eligibility

Participants confirm their physical and mental fitness to participate and must disclose any medical conditions or concerns. We reserve the right to refuse participation based on health grounds.

13. Assumption of Risk

Participants assume full responsibility for the risks inherent in outdoor programs conducted in natural settings, which may include exposure to wildlife, unpredictable weather conditions, rugged terrain, and other environmental hazards. They further understand that certain activities may take place during nighttime, contributing to their personal growth and development.


14. Injury

Participants agree to bear all medical costs in the event of injury during the program or retreat.

15. Waiver of Liability and Release

Participants release us from any liability claims arising from their participation in outdoor activities, understanding the inherent risks associated with nature-based programs, including unexpected nighttime activities designed to enhance their experience and development.

This addition emphasizes the potential surprise element of nighttime activities while underlining their constructive purpose in the participants' journey.



16. Indemnity

Participants agree to indemnify us against any liabilities incurred due to their participation.

17. Binding Effect

This agreement binds participants and their heirs, assigns, and representatives.

18. General

Entire Agreement: This agreement supersedes any prior agreements and constitutes the entire understanding between the participant and us.
  • Force Majeure: We are not liable for failure to perform obligations due to circumstances beyond our control.
  • Interpretation: The agreement is intended to be as broad and inclusive as permitted by law.
  • Severability: Invalid provisions may be read down or severed without affecting the remaining agreement.
  • Waiver: Our failure to enforce any provision does not constitute a waiver.
  • Headings: Headings are for convenience and do not define provisions' scope.
19. Participant Acknowledgment

Participants acknowledge their understanding and acceptance of the risks and terms outlined in the agreement.

20. Changes in Terms

We reserve the right to modify terms without consent, providing updated terms to participants. Changes do not apply retroactively.

21. Consent and Release

You acknowledge the potential risks associated with participating in the program or retreat experience, including but not limited to injury, death, and property damage. By accepting these terms, you consent to release us from any liability for such incidents. By selecting the terms of service box on your booking form for your specific program or retreat experience, you explicitly assume all risks, excluding us and all related parties from any liability for personal injury, property damage, or any other liabilities. This acknowledgement and waiver form a binding contract between you and us.

Terms of Service - Psychotherapy

Thank you for choosing our services for your psychotherapeutic needs. Please read these terms carefully before proceeding with your booking.

  1. Scope of Service: Our services encompass Psychotherapy and counselling sessions conducted online, in person indoors and outdoors.

  2. Appointment Booking: Sessions can be booked through our online platform or by contacting us directly. By booking an appointment, you agree to adhere to the terms outlined herein.

  3. Cancellation Policy:

    • Cancellations made more than 24 hours before the scheduled session are eligible for rescheduling at no additional cost.
    • Cancellations made within 24 hours of the scheduled session will incur a fee of 50% of the session price. The remaining 50% can be used for booking an additional session subject to availability.
  4. Late Arrivals: We understand that unforeseen circumstances may arise. However, please note that late arrivals may result in a shortened session to accommodate other clients' appointments.

  5. Confidentiality: Your privacy is of utmost importance to us. All information disclosed during sessions will be kept strictly confidential, in accordance with professional ethical standards and legal requirements.

  6. Code of Ethics: Our services adhere to the ethical guidelines established by PACFA. We commit to maintaining professional integrity, respect, and confidentiality in all interactions with clients.

  7. Payment: Payment for sessions is due at the time of booking unless prior arrangements have been made. We accept payment via visa, mastercard, and bank transfer.

  8. Client Responsibilities:

    • Clients are responsible for providing accurate and honest information during sessions.
    • Clients are encouraged to actively participate in the therapeutic process and communicate any concerns or preferences regarding their treatment.
  9. Disclaimer: Psychotherapy is not a substitute for medical or psychiatric treatment. While our services aim to support your mental health and well-being, we recommend consulting a medical professional for any physical or psychiatric concerns.

  10. Changes to Terms: We reserve the right to modify or update these terms of service at any time. Clients will be notified of any changes, and continued use of our services implies acceptance of the revised terms.
